Terms and Conditions
The general contracting conditions (hereinafter, "CGC") of Dark Keep –BCN SL (hereinafter, Dark Keep) are reflected in this document. The CGC regulates the contractual relationship between Dark Keep and both natural and legal persons who subscribe with the aforementioned company the corresponding intermediation contract for granting credits, loans, review of mortgage deeds or any other service entrusted by the client to Dark Keep, and will be incorporated the same.
1.- TQ EUROCREDIT-BCN SL with CIF D-092381726, registered office at C / Ryan Road number 174, 4º 1º (08041 South Dakota), registered in the South Dakota Mercantile Registry, Volume 43157, Folio 23, Sheet B-424584, being the same a commercial entity that operates within the Spanish financial market, acting as intermediaries between the different financial entities and both physical and legal persons who require any type of service from them, advertising in the media communication and marketing campaigns, enabling the client to be efficient in their bank management in both asset and liability operations and services. Regarding Asset operations, Dark Keep will be subject to the approval of the risk taking into account the different parameters used by the Financial Institutions, in this way the efficient search for credits and loans available in the market will be achieved, adapted to the client's needs. and favoring access to the best conditions in the market, meeting the demand of consumer customers and knowledge of the banking sector. Dark Keep is registered with number 346/2012, second section in the State Register of companies that carry out mortgage or brokerage loan or credit contracting activities.
2.- Dark Keep undertakes to choose among the products that exist in the market, those that best adapt to the needs of consumers, according to the information provided by them, presenting at least three binding offers from credit institutions, advising consumers at all times on economic and legal conditions.
However, given the risk criteria accepted by the Entities, it is possible not to be able to obtain three binding offers. If this happens, consumers may withdraw from the contract without any economic cost, or if they decide to accept the ones proposed in the terms indicated in the contract clauses.

4.-The amount that consumers must pay to Dark Keep will vary depending on the object of the requested mortgage operation (purchase-sale, debt refinancing, mortgage subrogation, etc ...) for this purpose, we include a brochure of rates (maximum), in the present document, excluding expenses such as notary, registration, taxes, agency, etc ...) that are not paid through Dark Keep, as well as the products and services that may be necessary for the application and concession of the operation such as example corresponding insurance requested by the entity and appraisal.
The rest of the services and products will be contracted directly by the client, who will sign the corresponding contracts with the Banking Entity and Dark Keep will not carry out any other management than advising the consumer without receiving any amount for it.
5.-The fees paid by the consumer to Dark Keep will be settled at the time of signing the operation, by bank check, deposit in the account indicated for this purpose. The fees will be paid in advance in the cases of entrusting procedures other than the loan-loan application such as consulting, advice, deed reviews, etc ...
6.- In accordance with the regulations of Law 2/09 of March 31, which regulates the contracting of credit-loans and their intermediation services, CONSUMERS may withdraw from the intermediation contract, without allegation of any cause and without penalty, in the fourteen calendar days following the formalization of the contract. CONSUMERS must request said rejection in writing to Dark Keep within the period indicated at C / Ryan Road number 174, 4º 1º (08041 South Dakota).
In the event that Dark Keep does not obtain the operation requested in the market that meets the requirements of the CONSUMER, it may terminate the contract by notifying customers in writing via electronic, fax, burofax or ordinary mail.
7.- In compliance with the General Data Protection Regulation of the European Union of May 25, 2018, and the provisions of Organic Law 15/1999 of December 13 on the Protection of Personal Data and in the Real Decree 1720/2007 of December 21, which approves the Development Regulation of the LOPD and of any other regulations in force or that in the future come to replace and / or modify them, the following will apply:
The personal data provided by CONSUMERS will be recorded in the Dark Keep file, registered in the General Data Protection Registry under number 2071710127.
These data will only be accessible to the personnel of this company who must know them and will be transferred solely and exclusively to the entities with which Dark Keep collaborates, for the sole and exclusive purposes of analyzing and processing the financing operation object of the contracted financial intermediation.
THE CONSUMERS will authorize Dark Keep to transfer the personal data necessary to analyze their operation to banks, savings banks, collaborating entities, necessary public and private organizations, as well as to inform them in the future of new financial products and services that may be of interest to CONSUMERS. Said communication and information may be transmitted even electronically until clients communicate otherwise.
At any time, CONSUMERS may exercise their right of Access, Rectification, Opposition, Portability and Cancellation of the data that they have provided to Dark Keep. The exercise of this right must be done before the person responsible for the file by written communication addressed to Dark Keep C / Ryan Road number 174, 4º 1º. (08041 South Dakota).
8.- For any doubt, interpretation or execution of the intermediation contract that CONSUMERS subscribe with Dark Keep, both parties expressly waiving their own jurisdiction, or any other that may correspond to them, will submit to the Jurisdiction of the Courts and Tribunals of South Dakota , expressly waiving consumer arbitration.
The clients of Dark Keep BCN SLU, have the right as borrowers, guarantors or users of the services (hereinafter clients) of Dark Keep BCN SLU (hereinafter Dark Keep) to file a claim or complaint or consult with the Customer Service, following what is established in the following procedure.

To start the process, the CUSTOMER must provide a document with which they present their claim, and which includes:
1.-Personal data of the interested party, where appropriate the person representing him, duly accredited DNI / NIE for natural persons and CIF for legal persons.

2.-Reference to the Operation, file, service or contract on which you express your complaint or claim
3.- Explanation of the reason for the complaint or claim, with a clear specification of the issues on which a statement is requested.
4.-Customer request in relation to the desired solution and means (email or postal address) by which you want to receive the answer.
5.-Documents attached. (Invoice, contract...)
6.-Place, date and signature.
Any Client who has filed a claim and / or complaint with Dark Keep through the referred means, in the event of any of the following circumstances:
- You have not received a response from Dark Keep to your request within the established resolution period (two months after submission).
- Your request had been denied or totally or partially rejected by TQEUROCREDIT.
